General Conditions for International Shipments

SEUR LAND CLASSIC SERVICE CONDITIONS

1. DELIVERY CONDITIONS: All shipments will be made carriage paid to the recipient’s address. For destinations outside the EU.
There are two types of shipment:
a. DAP. Carriage paid to the recipient’s address excl. customs formalities at destination.
b. DDP*. Carriage paid to address including customs formalities at destination, import duties and taxes. 

*IMPORTANT Shipments will only be accepted in DDP conditions if they are bound exclusively for Switzerland and Norway, sent by companies (not individuals) that also provide the commercial invoice and written acceptance of the Customs Clearance expenses in Switzerland/Norway and the duties and taxes that have to be settled in the country of destination.
 
2. WEIGHTS AND MEASURES:
- Maximum weight per package: 31.5 Kg. (and each package will be considered a shipment).
- Maximum length of the package: 175 cm.
- Calculation basis for volume limitation: Length in cm. + (width in cm. x2) + (height in cm. x2) must be less than or equal to 300 cm.
 
3. CUSTOMS FORMALITIES:
- DAP shipments: Customs office of exit formalities are included in the tariff.
- DAP shipments: Customs office of exit formalities are included in the tariff and customs clearance at destination formalities are as follows:
  • Switzerland: € 17 plus duties and taxes.
  • Norway: € 20 plus duties and taxes.
All shipments must be accompanied by the original commercial invoice issued in ENGLISH or Value Declaration, with the name and signature of the legal representative and mentioning specifically:
- Recipient's full address including Tel. and VAT.
- Incoterm (DAP or DDP).
- Country of Origin of the goods.
- Tariff item of each of the products in the shipment.
- Product units as well as unit and total units of value.
 
4. SPECIAL SURCHARGES: The islands of Corsica, Sardinia, Sicily and the Isle of Man: A €15 surcharge will be applied to the tariff.
 
5. TRANSIT TIME : The delivery times indicated do not include weekends or public holidays in any of the countries where the shipment is transited.
The transit times are indicative only as this is not an express service and refer to shipments sent from Spain.
 
6. LIMITATION OF LIABILITY: Maximum coverage €520 per package/shipment, included in the price.
 
7. DEADLINES FOR CLAIMS: In accordance with the provisions of article 30 of the C.M.R., a claim may be made to the Transport Agency within seven days of the receipt of the goods for any damage to or defect in the goods, unless that damage was evident at the time of receipt of said goods, in which case the claim will only be accepted upon their receipt. At the end of the aforementioned terms, no claim made to the Agency on the state in which the transported goods were delivered will be accepted. At the end of the aforementioned deadlines, actions arising from the carriage contract will expire after one year.
 
8. CASH ON DELIVERY (C.O.D) SERVICE: This service is not available.
 

SEUR NETEXPRESS SERVICE CONDITIONS

1. TRANSIT TIME : The delivery times indicated do not include weekends or public holidays in any of the countries where the shipment is transited. The transit times established refer to shipments sent from Spain. Transit times are not guaranteed when shipments are bound for trade shows, individuals, cash upon delivery shipments or are to consignees whose receipt of goods is subject to time restrictions.
 
2. DELIVERY CONDITIONS: All shipments will be made carriage paid to the recipient’s address. For destinations outside the EU there are two types of shipment:
a. DAP. Carriage paid to the recipient’s address excluding customs formalities in the country of destination.
b. DDP*. Carriage paid to address including customs formalities at destination, import duties and charges.

*IMPORTANT Shipments will only be accepted in DDP conditions if they are bound exclusively for Switzerland and Norway, sent by companies (not individuals) that also provide the commercial invoice and written acceptance of the Customs Clearance expenses in Switzerland/Norway and the duties and taxes that have to be settled in the country of destination.
 
3. WEIGHTS AND MEASURES:
- The maximum permitted weight per package is 1,000 kg.
- Maximum authorised measurements per package: 3m. X 1.2m. X 1.7m. (height)
The weight/volume ratio is calculated on the basis of 1 m3 = 167 kg.
 
4. SPECIAL SERVICES: Those international collection or delivery services for shipments that exceed the established weights and measures, or that require their collection or delivery at a specific time, or for a set duration, or auxiliary personnel, will be liable to a surcharge in the tariff.
 
5. CUSTOMS FORMALITIES:
Exports: The price of customs office of exit formalities is €20/shipment.
For DDP shipments to Switzerland or Norway, the price of customs clearance at destination formalities is €50 per shipment plus duties and taxes.
All shipments must be accompanied by the original commercial invoice issued in ENGLISH or Value Declaration, with the name and signature of the legal representative and mentioning specifically:
- Recipient's full address including Tel. and VAT.
- Incoterm (DAP or DDP).
- Country of Origin of the goods.
- Tariff item of each of the products in the shipment.
- Product units as well as unit and total units of value.
Imports: The price of customs clearance at origin formalities is €35 and the Official Tariff at destination plus duties and taxes.
 
6. SPECIAL SURCHARGES:
- Island of Corsica: 25% surcharge on the France price.
- Islands of Sardinia, Sicily: 25% surcharge on the Italy price.
- Channel Islands and Isle of Man: 25% surcharge on the United Kingdom price.
 
7. CASH ON DELIVERY (C.O.D) SERVICE: The NetExpress cash on delivery service consists of the delivery to the recipient of the goods upon receipt of a cheque for the amount requested by the sender, who recognises and accepts that means of payment. As means of payment for the amount requested, only current-account order cheques issued by the recipient in favour of the sender are accepted. The Transport Agency is not responsible for the proper use of the cheques delivered by the consignee The cash on delivery amount ordered by the sender must be established in the currency of the country of destination. Shipments with conditional delivery include a surcharge of 5% on the cash on delivery amount, min. €30.05 and max. €90.15, as a management fee.
 
8. LIMITATION OF LIABILITY: The liability of the transport company for any damage, loss or defects suffered by the goods is limited to a maximum amount of €10 €/kg in accordance with the provisions in the CMR convention, Protocol 5/7/78 (8.33 Units of Account / DEG. per kg).
 
9. DEADLINES FOR CLAIMS: In accordance with the provisions of article 30 of the C.M.R., a claim may be made to the Transport Agency within seven days of the receipt of the goods for any damage to or defect in the goods, unless that damage was evident at the time of receipt of said goods, in which case the claim will only be accepted upon their receipt. At the end of the aforementioned terms, no claim made to the Agency on the state in which the transported goods were delivered will be accepted. At the end of the aforementioned deadlines, actions arising from the carriage contract will expire after one year.
 

SEUR COURIER SERVICE CONDITIONS

1. DOCUMENTS The following are not considered as documents: Photos, Brochures, Magazines, CDs.
 
2. TRANSIT TIME : The days in transit (working days) are indicative and are for the sending of documents to the operational capitals of those countries. Always from cities in Spain with a Seur international daily connection, with carriage paid at Origin (please ask our Sales Department).
 
3. WEIGHTS AND MEASURES: In accordance with international standards, no package sent by the Courier service may exceed 31.5 kg in weight. The following dimensions are established:
- The maximum length for the measurement of the package is 175 cm.
- The total length must be less than or equal to 300 cm., in accordance with the following calculation method: Total length = LENGTH + (HEIGHT X 2) + (WIDTH X 2).
- The minimum dimensions will be those of an envelope measuring 22.9 cm. x 16.2 cm.
- The weight/volume ratio is calculated according to the IATA regulations on the basis of 1 m3 = 200 kg.

4- EXPORTS: All shipments bound for countries outside the EU that exceed 15 kg or with a value greater than €150 are subject to a customs office of export charge of €15.03.
 
5- LIMITATION OF LIABILITY: The maximum liability of the transport company for any damage, loss or defects suffered, except for late delivery, will be:

A. Documents €300.51 maximum per shipment.
B. Samples €1,202.02 maximum per shipment.
C. In those cases in which for any reason the guarantee coverage established in section A and B is not applicable, the limitations of liability established at any time by international air navigation standards shall apply.

6- DEADLINES FOR CLAIMS: In accordance with the provisions of article 124 of the Air Navigation Act, the action to demand the payment of compensation for damages and losses expires six months after the date on which they occurred. Claims for any damages or delays shall be made in writing to the carrier within 10 days of delivery or the date on which delivery should have been made. Failing to make this prior claim will prevent the exercise of the corresponding actions.
 
7- SAFETY STANDARD FOR TRANSPORT BY AIR: The customer must ensure, and attest to the completion of the delivery slip, or when making the delivery, that their shipment does not contain any prohibited article in accordance with national and international provisions that regulate the safety of air transport. They are also obliged to provide a complete description of the contents of the shipment in the delivery slip. Their liability is not extinguished by providing that information. The customer is hereby informed that their shipments may be subject to security checks, which may include the use of x-ray equipment and the inspection and opening of the shipment.
The customer certifies that the shipment has been prepared in secure facilities, by trusted employees, that the shipment has been protected against any type of unlawful interference during its preparation, storage and transport up to its acceptance for transport.
 
8. CASH ON DELIVERY (C.O.D) SERVICE: This service is not available.
 
9. DECLARED VALUE INSURANCE: The sender may request from the agency the taking out with the insurance company that it considers appropriate of an insurance policy that covers, with a real value declaration, the damage that the goods can potentially suffer up to their declared value. The price of this policy will be 1.25% of the declared value (minimum amount €6.12). If this policy is not taken out, the contractual limitations of liability outlined in point 5 will in any case apply. The above will not be altered by the necessary submission of documents in which, to carry out the transit of goods, there is reference to their value or content, which will be considered as a non-contractual declaration and for management purposes with third parties.
